1. Acceptance of Terms

These Terms of Use ("Terms") govern your access to and use of weareunsinkable.com and any related sites, content, programs, and services (collectively, the "Website"), operated by Unsinkable ("Unsinkable," "we," "us," or "our").

BY ACCESSING OR USING THE WEBSITE, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, PLEASE DO NOT USE THE WEBSITE.

By using the Website, you confirm that you have the legal capacity to enter into this agreement. If you are under the age of majority in your province or territory, you should review these Terms with a parent or guardian, particularly if you plan to submit a story or register for a program such as Unsinkable Youth.

2. Changes to These Terms

We may update or revise these Terms at any time, at our sole discretion. Changes take effect immediately upon posting to this page, and we will update the "Last updated" date above. Your continued use of the Website after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.

We may also change, suspend, or discontinue any part of the Website, including specific content, programs, or features, at any time without notice.

3. Who We Are

Unsinkable is a registered Canadian charity (Charitable Registration No. 70152 4910 RR0002) that supports Canadians through storytelling, peer connection, and community mental health programs.

4. About Storytelling and Personal Submissions

A core part of the Website invites users to submit personal stories, comments, photos, audio, video, or other content related to their lived experience ("Submissions") through channels such as our Storytelling, Youth, and Community Champions programs, among other features.

By providing a Submission, you agree that:

  • You are the original author of the Submission, or you have obtained all necessary rights and permissions from anyone else whose story, likeness, or personal information is included.

  • Your Submission does not infringe the rights of any third party and does not contain content that is unlawful, defamatory, harassing, hateful, sexually explicit, or otherwise objectionable.

  • You are voluntarily sharing your story and understand that, once published, it may be read, viewed, or shared by others, including outside of Unsinkable's direct control (for example, if shared on social media by another user).

  • You grant Unsinkable a non-exclusive, worldwide, royalty-free, and (unless otherwise agreed with us in writing) perpetual licence to use, reproduce, edit for length or clarity, publish, translate, and distribute your Submission — in whole or in part — across our Website, social media, print materials, events, and promotional materials, in connection with our charitable mission.

  • You may request that we remove or anonymize your Submission at any time by contacting us (see Section 12). We will make reasonable efforts to accommodate such requests, though previously distributed copies (e.g., printed materials already circulated) may not be recoverable.

We reserve the right, but are not obligated, to review, edit, decline to publish, or remove any Submission at our sole discretion, including content that we believe may be harmful to the author, to others, or inconsistent with our mission.

5. Acceptable Use

When using the Website, including any comment sections, forms, or community features, you agree not to:

  • Post or transmit content that is unlawful, threatening, abusive, harassing, defamatory, hateful, discriminatory, sexually explicit, or that could expose another person (including minors) to harm;

  • Impersonate any person or misrepresent your affiliation with Unsinkable or any other individual or organization;

  • Use the Website to harvest personal information about other users, or to send unsolicited communications, spam, or promotional material;

  • Attempt to interfere with, disrupt, or gain unauthorized access to the Website, its servers, or connected networks, including through viruses, bots, or scraping tools;

  • Use the Website for any unlawful purpose or in violation of these Terms.

We may remove content, suspend access, or take other action, in our sole discretion, in response to a violation of these Terms.

6. Intellectual Property

Unless otherwise indicated, all content on the Website — including text, graphics, logos, images, audio, video, and design — is owned by Unsinkable or used with permission from the rights holder (including individual storytellers, per Section 4) and is protected by Canadian and international copyright, trademark, and other intellectual property laws.

You may view, download, and print material from the Website for your own personal, non-commercial use only, provided you keep all copyright and other proprietary notices intact. You may not reproduce, republish, modify, distribute, or create derivative works from any content on the Website for commercial purposes without our prior written permission.

The name "Unsinkable," our logo, and related marks are the property of Unsinkable. Please contact us before using our name, logo, or any Website content in fundraising, media, or promotional materials.

7. Not Medical or Crisis Advice

Content on the Website — including personal stories, articles, and program information — is provided for general informational and peer-support purposes only. It is not medical, psychological, or professional advice, and is not a substitute for consultation with a qualified health care provider.

Unsinkable does not provide crisis support. If you are in crisis or need immediate help, please contact:

8. Programs and Events

References to Unsinkable programs (such as Unsinkable Youth, Community Champions, or Unsinkable @ Work) describe our current offerings, which may vary by region, be updated, or be discontinued at any time. Participation in any program may be subject to additional program-specific terms, waivers, or consent forms, which will be provided separately where applicable.

9. Donations and Purchases

Donations made through the Website are processed through our third-party partner, CanadaHelps, and are subject to CanadaHelps' own terms and privacy practices. Any purchases made through our Shop are similarly subject to the terms of the platform processing that transaction. We encourage you to review those third-party terms before completing a transaction. Questions about a donation or tax receipt can be directed to us using the contact information in Section 12.

The Website may contain links to third-party websites (including our social media channels, partner organizations, storyteller social media accounts, and/or crisis resources such as Talk Suicide and Kids Help Phone). These links are provided for your convenience. We do not control and are not responsible for the content, privacy practices, or availability of any linked third-party site, and inclusion of a link does not imply our endorsement of that site.

11. Disclaimer of Warranties and Limitation of Liability

The Website and its content are provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranty of accuracy, completeness, reliability, or fitness for a particular purpose. We do not guarantee that the Website will be uninterrupted, secure, or error-free.

To the fullest extent permitted by law, Unsinkable, its directors, staff, and volunteers will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of, or inability to use, the Website, any content on it, or any Submission posted by another user. Your use of the Website is at your own risk.

Nothing in these Terms limits any liability that cannot be excluded or limited under applicable Canadian law.

13. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Website will be subject to the exclusive jurisdiction of the courts of Ontario.

14. Severability and Entire Agreement

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. These Terms, together with our Privacy Policy and [Accessibility Statement], constitute the entire agreement between you and Unsinkable regarding your use of the Website.
